The privacy provisions under HIPAA that were afforded psychotherapy notes have now been extended to assessment data. This is a major victory for assessment psychologists and reflects efforts on the part of the APA Practice Directorate as well as the various assessment organizations including SPA. Of course, the "devil is in the details," and we will be monitoring closely as HHS implements the new regulations.

Threats to assessment at the legislative level continue. Maryland now allows counselors to do assessment "with appropriate training." The proposal in California that would eliminate the Board of Psychology and combine it with the Boards for other professions into a single generic "Mental Health Board" is a significant threat because it would likely allow all mental health professionals regardless of training to practice assessment. Members in California are urged to write your legislators to oppose this proposal.
